1. Who we are and this agreement

Layer is made by North Common Studios, operated by Max Tyrrell, Cooleven, Manor Avenue, Greystones, Co. Wicklow, Ireland ("Layer", "we", "us"). Contact: layer@northcommonstudio.com.

These terms apply to the Layer iPhone app and the Layer website at https://layer.northcommonstudio.com. By using Layer you agree to them. If you do not agree, please do not use Layer.

If you downloaded Layer from the App Store, your licence to use the app is Apple's Licensed Application End User License Agreement (apple.com/legal/internet-services/itunes/dev/stdeula). These terms add to it. If the two conflict, Apple's agreement applies to the licence and these terms apply to everything else.

Our Privacy Policy explains what data Layer uses and why. It is in the app under Settings → Privacy Policy and at https://layer.northcommonstudio.com/privacy.

2. Who can use Layer

You must be 16 or older to use Layer. Layer is for your personal, non-commercial use.

3. What Layer is

Layer helps you keep a private catalogue of the fragrances you own. It suggests what to wear, suggests which of your bottles might layer well together, shows information about fragrances, and makes cards you can share.

4. Your content

Your photos and your collection are yours. They are stored on your iPhone. We do not claim any rights over them and we cannot see them.

  • Only add photos that you took or have the right to use.
  • When you make a share card, you are the one publishing it, wherever you choose to post it. You are responsible for what you share.

5. Suggestions and fragrance information

  • Suggestions are opinions. Daily picks, seasons, occasions and layering pairings are generated from a fragrance's notes, by rules that run on your phone. They are labelled "Suggested" in the app. They can be wrong, and they are not professional advice.
  • Fragrance information comes from third parties and may contain errors. Notes are marked unverified until checked. If you spot a mistake, use Suggest a correction in the app.
  • Health and safety: Layer makes no claims about skin safety, allergies, ingredients, health effects or whether a product is genuine. If you have allergies or sensitive skin, check the product's own ingredient list and patch-test before use. Layering combines products; try a combination on a small area first.
  • If a suggestion looks wrong or offensive, use Report on it.

6. Prices and retailer links

If Layer shows prices or links to retailers:

  • Prices and availability come from third parties, can change at any time and may be out of date. The retailer's own website shows the final price.
  • We do not sell fragrances. Any purchase is between you and the retailer, and the retailer's terms apply.
  • Some links may be affiliate links, which means we may earn a commission at no extra cost to you. We label them and explain them in our Affiliate disclosure at https://layer.northcommonstudio.com/affiliate-disclosure.

7. Layer Privé

Layer Privé is an optional, auto-renewing subscription sold through Apple In-App Purchase. Apple is the seller of the subscription and takes the payment.

  • Price: the price and billing period are shown in the app before you buy, in your local currency, as set by the App Store.
  • Free trial: where a free trial is offered, its length and the date billing begins are shown before you start it. Unless you cancel at least 24 hours before the trial ends, it becomes a paid subscription.
  • Renewal: the subscription renews automatically at the end of each period unless you cancel at least 24 hours before the period ends.
  • Cancelling: cancel any time in your Apple ID subscription settings. In Layer, Settings → Manage subscription opens that screen. Your plan stays active until the end of the period you have paid for.
  • Refunds: Apple handles refunds under its own terms. You can request one at reportaproblem.apple.com. Your rights as a consumer under EU and Irish law are not affected.
  • If your subscription ends, nothing is deleted. Every bottle, photo and wear stays where it is. Only the Privé features switch off.

8. Founders' lifetime offer

If you join the Layer waitlist before Layer launches, we will email you an offer for lifetime access to Layer Privé as a one-time purchase, at the same price as one year of Layer Privé.

  • How you get it: your launch email contains a code or link from the App Store. You redeem it through Apple, who sell the purchase and take the payment. The price, in your currency, is shown by the App Store before you confirm.
  • Who can use it: anyone who joined the waitlist before launch. One offer per person, for your own personal use. It cannot be sold or transferred.
  • How long it is open: 60 days from the launch email. After that the code stops working, and Layer Privé is available as a subscription.
  • What "lifetime" means: access to the Layer Privé features for as long as Layer Privé is offered. Features may be added, changed or retired over time. If we ever stop offering Layer Privé, we will give you at least six months' notice.
  • No promise to launch: joining the waitlist is not a purchase. We plan to launch Layer, but we cannot promise a date, and no contract for the offer exists until you redeem it. Your rights as a consumer are not affected.

9. Changes to Layer

We keep improving Layer, so features will change. If we make a change that materially reduces what you get from a paid Privé subscription during a period you have already paid for, we will tell you in advance, and you may end the subscription and ask Apple for a refund for the remaining period, as EU law allows.

10. Your rights as a consumer

If you are a consumer in the EU, you have legal rights in relation to digital content and services that are faulty or not as described, including under the Irish Consumer Rights Act 2022. Nothing in these terms takes those rights away.

11. Acceptable use

Please do not:

  • try to break, overload, reverse-engineer or copy the app or its servers;
  • scrape fragrance data or prices from Layer, or resell anything from it;
  • use Layer for anything unlawful, or to infringe anyone else's rights.

12. Trademarks

Fragrance and brand names are trademarks of their respective owners. Layer uses them only to identify fragrances. Layer is not affiliated with, endorsed by, or sponsored by any fragrance house or retailer. No brand logos are used.

"Layer", "Layer Privé" and the Layer logo belong to us.

13. The website

The guides on our website are general information about fragrance, written for enjoyment. They are not professional, medical or safety advice. If you have allergies or sensitive skin, check a product's ingredients and patch-test it before use.

The website and the guides, including the text, design and layout, belong to us or our licensors. You may read and share links to them, but please do not copy them in bulk or republish them without asking.

Our website may link to other websites, including retailers. We do not control them and are not responsible for their content or their privacy practices.

If you join the waitlist, we will send you one email when Layer launches, with your founders' lifetime offer (section 8), as explained in the Privacy Policy.

14. Our responsibility to you

We work hard to keep Layer available and accurate, but we cannot promise it will always be uninterrupted or error-free, or that third-party information in it is always correct.

To the extent the law allows, we are not responsible for losses that were not reasonably foreseeable, or for losses caused by events outside our reasonable control.

Nothing in these terms limits or excludes our liability where the law does not allow it, including for death or personal injury caused by our negligence, for fraud, or for your statutory rights as a consumer.

15. Ending

You can stop using Layer at any time by deleting the app. That also deletes your collection, so export it first if you want to keep it (Settings → Export my data).

We may suspend access to online features for anyone who seriously breaks these terms. If we ever stop offering Layer, we will give you reasonable notice.

16. Changes to these terms

We may update these terms. If a change is significant, we will tell you in the app before it takes effect. The date at the top shows the latest version.

17. Law and disputes

Irish law applies to these terms. If you are a consumer living elsewhere in the EU, you also keep the protection of the mandatory laws of your country, and you can bring a claim in your local courts.
